| 土地发展权配置兼顾政治秩序、经济效率、社会公平、生态效益与文化价值,是在土地开发、利用和保护过程中,平衡公共利益与私人权益的一种政府调控和市场优化的混合型政策工具。土地发展权配置与新发展格局具有价值目标趋同、制度内容耦合、推进手段相似等内在关联特征,通过城乡、区域之间的要素流动缓解发展不平衡不充分矛盾。研究发现,我国土地发展权配置价值导向经历了“效率优先→公平优先→效率公平兼顾”的演变历程,逐渐呈现“权益+机会+规则”公平、“空间+结构+规模”效率、“经济+政治+社会”秩序、“生态+文化”可持续等多重需求逻辑趋势。新时期通过土地发展权政策工具助力新发展格局构建,需要优化土地权利立法、规划导向制度顶层设计,细化土地发展权配置原则、转移范围和二维尺度的操作细则,强化收益分配、财政金融、技术支撑、监管奖惩等配套机制,全面激发城乡区域经济循环发展动力,推进国家土地治理体系和治理能力现代化建设。 |

| The allocation of land development right takes into account political order, economic efficiency, social equity, ecological benefits and cultural values. It is a mixed policy tool of government regulation and market optimization to balance public interests and private interests in the process of land development, utilization and protection. The allocation of land development right and new development pattern of domestic circulation have internal consistency, such as value goal convergence, institutional content coupling, and similar means of promotion. Relieve the imbalanced and insufficient regional development contradictions through the flow of elements between cities, townships, and regions. It is found that the value orientation of land development right allocation in China has undergone an evolution process from “efficiency priority → fairness priority → efficiency and fairness balance”, gradually presenting multiple demand logical trends such as “rights + opportunities + rules” fairness, “space + structure + scale” efficiency, “economy + politics + society” order, and “ecology + culture” sustainability. In the new era, with the help of land development right policy tools to help build the new development pattern, we should optimize the top-level design of system of land rights legislation and planning guidance; refine the operational rules of land development right allocation principles, transfer scope and two-dimensional scale; strengthen supporting mechanisms such as income distribution, fiscal and financial support, technical support, and regulatory rewards and punishments, comprehensively stimulate the driving force of circular economic development in urban and rural areas, and promote the modernization of the national land governance system and governance capacity. |
